General Terms & Conditions

Payment: All prices stated on Pacific Marketing Agency are in USD (United States Dollar) and before the required tax in Costa Rica (13% VAT). It is essential that payment is always confirmed before our team commences work. We offer a variety of convenient payment methods, including most major credit cards via our online credit card processor, TiloPay (a third-party company), PayPal, and local bank transfers (for customers in Costa Rica). Our payment methods opt for recurring payments to ensure no subscription payment errors, providing you with a seamless payment experience. We may also accept Bitcoin (contact us for more information; it is not available for all services).

Refunds: You have 48 hours from purchase to claim a refund if you wish not to move forward without services. After 48 hours, there are no refunds, as your project has now been processed. If you cancel a subscription-based solution between payment dates, no refund will be used, and our servers will run the course until the payment period is complete.

Language: We provide support and business solutions in English and Spanish. We are based in Costa Rica, but our reach is not limited to customers residing in the country; we have customers worldwide.

Customer Support: Our online support services are available Monday through Friday, from 10:00 AM to 4:00 PM Central Standard Time (GMT/UTC-6). We address all inquiries in the order they are received. A representative from Pacific Marketing Agency will respond to your request at our earliest convenience.

Billing Information: Our services are invoiced under three authorized entities: Pacific Marketing Agency, REY Design (previously operating as REY Design from April 2020 to September 2024), or our managing partner, Johnathan Alan Reynar. To ensure the security of your transactions, we kindly request that you verify the billing entity whenever you receive a payment link. These are the only authorized sources for charges related to our services.

For Customers in Costa Rica: If you require an electronic invoice (factura electrónica), kindly provide your necessary credentials for invoice generation. Our billing will be processed under our professional services entity: Johnathan Alan Reynar, Cédula DIMEX 112400331318 (tax identification number), Jaco, Costa Rica 61101. Privacy

Cookies and Cache: Our website uses these features to enhance your web viewing experience; no personal data is attached to cookies and cache. Basically, the first time you visit the website, your device will save certain information about our website to provide faster load times and possible language preferences.

Personal Information Provided in Forms: Any personal or business information you provide to Pacific Marketing Agency will always be confidential. We take your privacy seriously and do not sell your information or give it to any other individual or business. We only require the information (marked with *) to ensure we have proper contact information and any criteria to complete the requested solution. Your information is safe with us.

Payment Security: Our website uses valid SSL security certificates to ensure all the information you input while purchasing is secure. Our payment methods, TiloPay and PayPal, also use the latest security measures to ensure safe transactions.

Website Trackers: Our website uses trackers; the sole purpose of trackers is marketing and analytics reporting. The information we can gather from this is how long a user is on the website, their navigation through the website, and how they found the website or via what link brought them to the site. The information is always generic; we cannot see it was you, your name, email, or any personal information. We can only see generic areas such as your country or province/state, allowing us to target marketing or reach new areas.

Emails: When you purchase any product/solution from Pacific Marketing Agency, you will provide us with your contact information. We will add you to our database, where periodic emails will be sent. If you receive email marketing with discounts, new services, or information, you may opt to remove your email from the subscription list. We will not fill your inbox with spam, which is why we recommend that the main contact of your account stays subscribed so you can stay informed.

Websites

One-time-payment Websites: Purchasing one of our pre-built website packages automatically sets the annual renewal for $160+tax (renewal rate may vary depending on add-ons and other services). Payment must be confirmed before any work begins. We provide CMS backend, Cpanel access, and master files upon completion. There are no strings attached, and you have complete access and control of the website built by Pacific Marketing Agency. For customers in Costa Rica, we can provide Electronic Billing (Factura Electronica) if needed; we require your accounting information to do so.

Once the website becomes live to the public, a complementary three-month add-on of support and management will be activated; it can be renewed if desired; visit Management & Support.

Once we provide all access to your website files, Pacific Marketing Agency is not responsible for any loss of information or damages to your site. We recommend saving this information in a safe location. As long as you are on our server, we can always regain access if this information is lost.

Subscription-based Websites: Subscriptions will be automatically charged every month until canceled. Upon payment failure, we offer a seven-day grace period, after this period, the website will be suspended, and all services will be paused until payment is confirmed. An account may remain suspended for up to two months before the content created by Pacific Marketing Agency is permanently removed. At this point, your server and website will be deleted, and we will be unable to recover the files. If you wish to retain ownership of your website, you have the option to complete the website buyout process after the sixth month of your subscription. We maintain the rights to everything created during your website subscription and are free to use your website design if desired.

*The standard SEO plan and Google Ads budget for selected subscriptions will start in the third month.

All subscriptions are a partnership between you (the client) and the developer (Pacific Marketing Agency); a buyout is required to leave a subscription with your website. Buyouts are available after six months. Buyout pricing is based on the website; standard rates are one to five pages for $500+tax and ten pages plus $1,000+tax. Upon completing the buyout, we will provide you with CMS backend, Cpanel access, and your website master file. Included with your buyout is one year of your domain, hosting, and SSL; if you wish to continue with our server, you can continue to pay the annual fee of $160+tax (a yearly cost may vary depending on add-ons and other services).

During your subscription, Pacific Marketing Agency will be the only company to manage and make changes to the website; upon the buyout, our agreement is completed, and any other individual or agency can access your website with your permission. Once we provide all access to your website files, Pacific Marketing Agency is not responsible for any loss of information or damages to your site. We recommend saving this information in a safe location; as long as you are on our server, we can always regain access if this information is lost.

Hosting

Web hosting plans are all shared hosting accounts with individual quotas, bandwidth, and Cpanel access. Monthly bandwidth can be adjusted based on website needs. Pacific Marketing Agency is an authorized reseller of our server. 99% Uptime and downtime on our server is not guaranteed; we are not responsible for unforeseen circumstances but will work on a solution as soon as an error occurs.

Management

Websites developed by Pacific Marketing Agency are automatically eligible for our management and support plans. For websites created elsewhere, an initial assessment is required. Our standard rate for website management services outside of our plans is $30 per hour. We kindly request that all payments be confirmed prior to the commencement of any work. Project timelines are determined based on the current workload at the time of order placement, and we will provide an estimated completion date upon request.

Web SEO

Once payment is confirmed you’ll receive an email with the first steps to begin your SEO plan. Other budgets are available with advanced and personalized service. SEO results are not immediate and take time to reach the desired ranking, especially if your business market has a high competition rate in your area. We recommend a minimum of a three month plan to see results.

Social Media Marketing

Once payment is confirmed you’ll receive an email with the first steps to begin your selected social media marketing plan. Creative content sessions (photo & video) are only available for customers in Costa Rica. No price reductions for customers outside Costa Rica. Included paid advertisements are controlled by the project manager. If you wish to add additional boosted posts please communicate this directly with your project manager. Our pre-built plans are for a single account only, please contact us for a personalized solution if you manage multiple accounts. The customer must provide access to all accounts, and provide any marketing content or guide to start the campaign. We currently manage accounts on Facebook, Instagram, YouTube, & TikTok.

Google Ads

Once payment is confirmed you’ll receive an email with the first steps to begin your Google Ad campaign. Google Ads require a minimum of three month contract to ensure tailored results to your business market. We only charge and bill for our management fees 30% of budget (larger budgets are available and management fee capping). A credit card is required to purchase the budget once we’ve created your account. Personalized solutions are available for custom budgets.

Content Writing

Once payment is confirmed you’ll receive an email with the first steps to begin brainstorming your articles. Each blog article includes two revisions. Turnaround times 3 to 14 days. Article length can be adjusted based on requirements.

Photo & Video

Booking: Availability must first be confirmed; upon availability, we will provide an invoice link for payment via credit card, PayPal information, or local bank transfer/SINPE. Photography/Video production is available to customers in Costa Rica. While we are not limited to this, we’d have to quote a personalized solution if we are outside the country (as we have previously traveled outside for work). Prices quoted on our website are for the Central Valley (San Jose) to the country’s Central Pacific (Jaco) area. Additional fees for transportation and other expenses will be added to the quote outside these areas.

Deposits: All sessions require a minimum 50% deposit to hold the date and time. This deposit is only refundable within 48 hours of reserving; after that, it is not refundable. The remaining balance is due in cash on the day of the session or by the same method as the deposit.

Photos: Prices do not include prints; all photos will be sent via a high-definition digital gallery. The digital gallery will be available for one month from the date uploaded. To ensure you do not lose your created content, please ensure you download the images to your devices for safekeeping. Failing to do so is not Pacific’s responsibility.

RAW Files: Prices do not RAW files, if you wish to obtain the RAW photo/video files you can do so for an additional $25.

Cancellation Policy: Contact us within 48 hours of reserving for a refund of the deposit; after that, the deposit is not refundable. Rescheduling may apply in certain circumstances; please contact us for more information. Understand that upon canceling, there are processing fees for transactions that you might forfeit upon request, and this is not Pacific’s responsibility.

Graphics

Payment must be confirmed before any design work initiates. Design turnaround depends on size of project and current workload, you’ll be notified beforehand if we are backed up on designs, typically the design turnaround is between 7 to 14 days. All graphics must be checked by customer before going to printers, once approved, Pacific Marketing Agency is not responsible for any errors or misprints.

Company Branding
